These terms apply to using the French Flashcards app for iPhone and iPad and to in-app purchases in it.

1. Provider and scope

The app is provided by Melih Firat (“we”). It is distributed through Apple’s App Store. Besides these terms, Apple’s Licensed Application End User License Agreement (EULA) applies; where they conflict, these terms take precedence as far as the EULA allows.

The web app at french.lingotivo.com has its own terms of service.

2. Services

French Flashcards is a learning app that teaches 3,747 French words from A1 to B1. The app is free and includes selected free content; you can unlock everything else with an in-app purchase (Pro). The app shows what is free and what Pro includes.

The app is independent and not affiliated with any exam provider. We provide learning content; we do not promise that you will pass an exam.

3. In-app purchases

Pro for French Flashcards is available as:

  • Pro Monthly (product ID: delf_a1_to_b1_pro_monthly): a subscription that runs for one month and renews automatically
  • Pro Annual (product ID: delf_a1_to_b1_pro_annual): a subscription that runs for one year and renews automatically
  • Pro Lifetime (product ID: delf_a1_to_b1_pro_lifetime): a one-time purchase with no term; it doesn’t renew and needs no cancelling

Every plan unlocks the same Pro content of French Flashcards. A purchase applies to French Flashcards only; our other apps are sold separately. The prices shown in the app before you buy, in your local currency, apply.

Apple is the seller of in-app purchases. Payment is charged to your Apple Account when you confirm the purchase. Subscriptions renew automatically for the same term unless you turn off auto-renewal at least 24 hours before the end of the current period; the renewal is charged within 24 hours before the period ends.

You manage and cancel subscriptions in your Apple Account settings (Settings › [your name] › Subscriptions). After cancelling, you keep Pro until the end of the paid period. If the app offers a free trial, any unused part of it is forfeited when you buy a subscription.

Refunds and any statutory right of withdrawal follow Apple’s terms; you can request them at reportaproblem.apple.com. Use “Restore purchases” in the app to use Pro on other devices with the same Apple Account.

4. Rights of use

All content in the app (texts, tasks, audio, graphics) is protected by copyright. You receive a simple, non-transferable right to use the app for your own learning. In particular, you may not copy, share or publish the content or decompile the app, except where the law expressly allows it.

5. Availability and changes

We improve and update the app and its content. We will not remove essential parts of Pro you bought during the paid term. Free content may change.

Your learning progress is stored only on your device. It may be lost if you delete the app or switch devices without a backup; we are not liable for this.

6. Liability

We are liable without limitation for intent and gross negligence, for injury to life, body or health, and under the Product Liability Act.

For slight negligence we are liable only for breaches of essential contractual obligations (obligations that make performing the contract possible in the first place and on which you may regularly rely), limited to the damage typical for the contract and foreseeable. Otherwise liability is excluded.

7. Apple

These terms are between you and us, not Apple. We alone are responsible for the app and its content, maintenance and support. Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you.

8. Contact and support

Please send questions, bug reports or wishes about the app to melihfiratapps@gmail.com.

9. Final provisions

German law applies, excluding the UN Convention on Contracts for the International Sale of Goods. For consumers, this choice of law applies only insofar as it does not remove the protection of mandatory provisions of the country where they habitually live.

We are neither willing nor obliged to take part in dispute resolution proceedings before a consumer arbitration board.

If individual provisions are invalid, the rest of the contract remains valid.

The German version of these terms is legally binding.
